How to choose a notary for a property transaction in Estonia

How should a notary be selected when selling an apartment, house or plot in Estonia? The notary does not have to be in the same city as the property. In practice, the available date, working language, complexity of the transaction and the option to participate in the office, remotely or in hybrid form are the relevant criteria.

A notary may be selected anywhere in Estonia

According to the Estonian Chamber of Notaries, a person may approach a suitable notary irrespective of the parties' residence or the location of the property. A Tallinn apartment sale therefore does not have to take place in a Tallinn notary's office. If the parties are in different cities, an office with an earlier appointment or the necessary language capability may be more practical.

The notary is usually proposed by the seller, buyer, estate agent or financing bank and selected by agreement. The notary must remain impartial. The fact that one party suggested the office does not allow that party to determine the contractual terms without the other party's knowledge.

Describe the transaction before requesting an appointment

Tell the office immediately if the sale involves co-ownership, inherited property, a minor's property, several mortgages, company-owned property or a party abroad. State the price, financing, preferred timing and working languages. This allows the notary to assess the documents and the realistic preparation time.

Ask when the draft will be sent, how corrections should be submitted and whether a bank must provide separate instructions. An early appointment is not useful if the information needed to prepare the transaction is missing. For a complex sale, substantive readiness matters more than the first empty slot in the calendar.

Notarial fees are regulated and depend on the transaction

Notarial fees are regulated by law, and the cost of a property transaction depends on the transaction value and the acts performed. Additional charges may arise for a mortgage, deposit account, copies or remote authentication. The total can therefore vary with the structure of the transaction.

Ask the office for an initial calculation based on the actual details. The Chamber of Notaries' calculator provides an approximate result, while the notary confirms the final amount. A verbal estimate from an estate agent does not replace the official calculation.

Office, remote or hybrid authentication

Remote authentication can be practical where parties are in different countries or cities. In a hybrid transaction, one party attends the office and another participates by video. In both cases, the notary verifies identity and explains the transaction on the same principles as an office appointment.

Remote authentication is an option rather than an automatic right for every act. The notary decides whether it is suitable, and the participant needs a working digital identity method, internet connection and quiet environment. If the technology is difficult to use, an office meeting may be the safer choice.
